DESIGNER TERMS
Each Designer at The Digital ScrapBook Shop retains and reserves the right to modify, update and change their terms of use (TOU) for all digital designs at any time with or without notice. It is the customer's responsibility to check for updates and changes to the Terms of Use.
Copyright of all of the graphic images created by the designer for sale at The Digital ScrapBook Shop, including any images and free items, are retained by the original creator. The Digital ScrapBook Shop is not responsible for copyright violation. All graphic images are copyrighted by the designer with all rights reserved.
If you are uncertain of a way you'd like to use any of our images, please contact us with any questions you may have, we will be happy to assist you!
Please note that if you fail to follow our terms, we will ask you to change or remove products you may be selling. Additionally, you may also be billed for unpaid extended licensing fees.
LIMITED LIABILITY
Designers and/or The Digital ScrapBook Shop shall not be held liable for any damages resulting from the use of these items. Although we do our best to ensure virus-free files, The Digital ScrapBook Shop cannot guarantee that all files available for download are free from virus. It is the customer's responsibility to scan files and protect their computer and equipment. The Digital ScrapBook Shop is not responsible for damage to your computer, files, or electronic equipment, resulting from the use of our website or services. The Digital ScrapBook Shop is not liable for any damages, including loss of revenue, from such damage.
Copyright is the soul responsibility of individual designers. If any legal action arises out of copyright infringement, The Digital ScrapBook Shop shall be indemnified and held harmless of any and all costs or damages that it's designer's or agents incur.
COPYRIGHT POLICY
All copyrights to elements, graphics, and kits within this site are retained by the original creator. All graphic images are copyrighted the designer with all rights reserved. Graphic images are for personal use only, unless otherwise stated in the product's terms of use.
UNAUTHORIZED USE
It is illegal to reproduce or distribute copyrighted material without the permission of the copyright owner. Accessing the images and text provided within these products does not give you any right to use them without the permission of the copyright owner. All materials created by the designer, including but not limited to images and text, are protected by copyright under Canadian copyright laws, international conventions, and other copyright laws. You cannot use the content except as specified herein. You agree to follow all instructions within these terms and are limited in the way you may use the content.
CREDITING THE DESIGNERS
Please be sure to credit the designer and product/kit/item name. If you have any concerns, comments or questions regarding the product, or to request permission for commercial use, please contact the designer. If you have any concerns, comments or questions regarding your purchasing process, or a corrupt file, please contact us.
ACCOUNTS
One account per person. Your Digital ScrapBook Shop account is only to be used by you and download links and files are not to be shared. Persons found violating this rule may be subject to having their account disabled and ultimately being banned from The Digital ScrapBook Shop site.
RETURNS
Due to the nature of our online site, The Digital ScrapBook Shop have a strict NO RETURN policy for any products and all sales are final. If it appears there has been a problem with your order, or you have questions, please contact us and we will get back to you as soon as possible.
DUPLICATE PURCHASES
It is the customer's responsibility to ensure that the products they plan to buy have not been already bought because no exchange / refund will be given. We recommend that you keep a track of your purchases, or, check into your history, if you have any doubt about a product, before purchasing it again.
DOWNLOADS / LINK RESETS
At "The Digital ScrapBook Shop", your download links will be always available in your account. But, if a designer remove some products from our server, your download links will no longer be functional and no resets will be possible.
So, make sure to download, unzip and check your purchases to be sure that they have been successfully transferred into your computer. It is your responsability to back up your files and we strongly encourage you to do it on an external hard drive or disk.
REFUNDS
As all store products are digitally downloadable, no refunds can be made, except for damaged product, or, for a file that is empty (at your request).
PAYPAL DISPUTE CASES / REVERSALS
When a dispute case is opened through PayPal, customer is automatically blocked temporarily from the store until the case is solved.
Paypal reversals will not be tolerated and constitute an internet fraud. Not only you will be banned from shopping at The Digital ScrapBook Shop, but all the information obtained from these purchases will be forwarded to the proper authorities.
INCOMPATIBLE FILES / SOFTWARES
Our product listings state the file types included, we will not offer any refunds if you purchase something you cannot use. Please be sure to clearly read the descriptions before you purchase. Should you have any questions you can always email us and ask beforehand. We will do our best to help get you a file type that can work for you.
SALES / REDUCED PRICING
At any time, The Digital ScrapBook Shop may have items available on sale or at reduced prices. If you order that item previously or after the time the item is on sale, you will not be given that sale price. The sale or reduced price is only honored when the item is ordered with in the time frame it is on sale or the price is reduced.
